PRIVACY NOTICE
The “Ley Federal de Protección de Datos Personales en Posesión de los Particulares” and it ́s “Reglamento” (Federal Law on the Protection of Personal Data Held by Private Parties and it ́s Regulations) constitute the general framework that establishes the rules, requirements, conditions, and minimum obligations to guarantee adequate treatment of personal information provided to individuals in the exercise of their activities.
Among the principles of personal data protection, the principle of information stands out, which aims to effectively inform the data subject of the existence of the processing of their personal information and its essential characteristics, in terms that are easily understandable, with the purpose of enabling them to exercise their right to informational self-determination and protection of personal data before the data controller.
This principle of information, in terms of Articles 15 of the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares” (Federal Law on the Protection of Personal Data Held by Private Parties) and 23 of its Regulations, is physically materialized through the provision of the Privacy Notice to the data subject.
Understanding the Privacy Notice as the document by which the data controller informs the data subject about the terms under which their personal data will be processed, highlighting the identity of the natural or legal person who decides to carry it out, the data collected, the purposes or actions that motivate the collection, the use and custody that will be given to such personal information, the third parties to whom such personal data will be transferred, the mechanisms made available to the data subject to exercise the rights linked to the protection of such personal data (in particular, the ARCO rights), among other matters.
Reasons and bases in accordance with which the following is made available to you:
PRIVACY NOTICE
Out of respect and protection for your privacy, in compliance with the provisions of the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares” (Federal Law on the Protection of Personal Data Held by Private Parties) hereinafter “the Law”, the following Privacy Notice is made available to inform you about the treatment that will be given to your personal data that you kindly share for the purposes of the integration of the Bariatric Postoperative Card (BP Card).
In this regard, the following information is provided:
I. IDENTITY AND ADDRESS OF THE RESPONSIBLE PARTY COLLECTING PERSONAL DATA:
Antonio Marmolejo Chavira, with address at Calle Cumbres de Acultzingo 194, Interior 302, Colonia San Andrés Atenco, Tlalnepantla de Baz, State of Mexico, C.P. 54040, is the person responsible for the treatment and protection of your personal data, who undertakes to safeguard their confidentiality, establishing administrative, technical, and physical security measures to guarantee their protection against any damage, loss, alteration, destruction, and/or against any unauthorized use, access, or processing.
II. DATA COLLECTED
The personal data that may be collected for the purposes described herein include, but are not limited to, the following:
– Identification data: such as full name, address, phone number, email address, date of birth, marital status, age, gender, nationality, among others.
– Health data: such as medical history, current conditions, medical treatments, allergies, blood type, among others.
– Employment data: such as occupation, workplace, among others.
– Financial data: such as information related to payments for medical services, tax data, among others.
III. PURPOSES OF PROCESSING PERSONAL DATA
The personal data that is collected will have the purpose of integrating the respective Bariatric Postoperative Card (BP Card), which has been designed to standardize the perioperative medical history of the bariatric patient.
Likewise, the personal data that is collected will have the purpose of generating and monitoring your medical history, billing and collection of services, conducting statistical analysis and service improvement, as well as complying with legal obligations and requirements of the competent authority.
Your contact personal data may be used to send you information about the provision of services and promotions related to the aforementioned purposes.
IV. TRANSFER OF PERSONAL DATA
The personal data provided will be used exclusively for the purposes indicated in this Privacy Notice, which may be transferred to the treating healthcare professionals in each case, clinical laboratories, healthcare institutions, insurers, among others, solely for the purposes described in this Notice.
V. RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION OF YOUR PERSONAL DATA (ARCO RIGHTS)
Article 16 of the “Constitución Política de los Estados Unidos Mexicanos” (Political Constitution of the United Mexican States) recognizes that every person has the right to the protection of their personal data, access, rectification, and cancellation thereof, as well as to express their opposition in the terms established by the Law, which will establish the exceptions to the principles governing the processing of data.
In this regard, as the data subject providing the personal data, you have the right at any time to:
– Access, without limitation, to your personal data;
– Rectify them in case they are inaccurate, incomplete, or not up-to-date;
– Cancel them, when their conservation is not necessary; or
– Oppose the processing thereof, when you consider that it would cause you harm or damage.
To exercise the Rights of Access, Rectification, Cancellation or Opposition of your personal data (ARCO Rights), you or your legal representative must submit the respective request to the email address dr.marmolejo.ch@gmail.com, accompanied by the following information:
1. Full name and contact information, including full address (street, interior and/or exterior number, neighborhood, zip code, city, and state) and email address for such purposes;
2. Identification to prove your identity (voter ID card, valid passport, professional license, or immigration document);
3. In case the applicant is not the data subject, the legal instrument proving the representation of the data subject regarding which any of the ARCO Rights are requested, that is, the public instrument containing said representation or the power of attorney signed before two witnesses, along with identification of the data subject, the representative, and the witnesses (voter ID card, valid passport, professional license, or immigration document).
– In the case of minors, legal documents proving the legal representation of the minor will be required, either as a parent and/or guardian, accompanied by the birth certificate and photo ID of the minor.
4. A clear and precise description of the personal data about which you wish to exercise any of the ARCO Rights, the right you wish to exercise, and the reasons why you wish to exercise it;
5. In case of requesting a rectification of data, please also indicate the modifications to be made, providing the documentation supporting your request; and
6. Any other element that allows identifying or locating the personal data in question.
For the aforementioned purposes, additional documentation may be requested if necessary, as well as the verification of the documents supporting your request.
The exercise of the “ARCO Rights” will be free of charge.
VI. MODIFICATIONS TO THE PRIVACY NOTICE
This Privacy Notice may be subject, at any time, to modifications and/or updates, which will be communicated personally or through the publication of the modified and/or updated Notice in a visible place and/or on the internet page of the advertising of the Bariatric Postoperative Card (BP Card).
VII. CONSENT
By providing your personal data, you express your consent for them to be processed in accordance with the purposes described in this Privacy Notice.
